The Enforcement Conduct Board Standards Consultation is now open

The Enforcement Conduct Board (ECB) has initiated its standards consultation as part of its mission to ensure fair treatment for everyone subject to enforcement action. Responses must be submitted by 13th September!


Background

Enforcement Conduct Board

As part of the ECB’s commitment to fairness, they are producing a new set of standards for enforcement agents and enforcement agencies. This is to ensure that both enforcement agents and individuals subject to enforcement action understand what fair enforcement means in practice.


About the consultation

This consultation has been developed through collaboration with all stakeholders, including debtors, debt advisors, and the enforcement industry. It presents the ECB’s first comprehensive draft of the proposed new standards for enforcement work, building on the current National Standards established by the Ministry of Justice. The ECB intends that its standards will replace the current National Standards, and it is working with the MoJ to ensure that enforcement agents and agencies have one clear set of standards to follow.


For the first time, these standards will impose responsibilities on both enforcement firms and agents, becoming a condition for ECB accreditation in the future. They also address "grey areas" in the National Standards and cover key issues such as property entry methods and the misrepresentation of powers. Additionally, the consultation outlines the proposed second-year accreditation criteria for the ECB, its operational oversight model, and its complaints model.
