Warrant to Forfeit

The Distress for Rent Rules 1988 allow a landlord to instruct bailiffs to recover commercial rent arrears without the need for a court order.

 

There are 2 routes to recovery:

Forfeiture

Providing it is written into your tenancy agreement, a landlord can exercise his right to regain possession of his property without court action.  Forfeiture should only be considered where:

Locksmiths may be used to gain entry to the property and exclude the tenant.  The costs of such action are paid by the landlord but are usually recovered from the tenant at a later date.
