Warrant To Distrain

The Distress for Rent Rules 1988 allows you to instruct bailiffs to recover commercial rent arrears without the need for a court order.

 

There are 2 routes to recovery:

Distraint

This is the process of entry, removal or threat to remove goods in order to enforce the debt.  In our experience, it is the most effective method to recover rent arrears as it usually results in the tenant making payment to prevent goods being removed and sold.  The tenant pays all costs associated with the bailiff’s attendance.  In some cases, goods may not be removed immediately as they will be left on the premises under a walking possession order while payment is arranged.  This method will enable you to maintain your landlord/tenant relationship.
