The Distress for Rent Rules 1988 allows you to instruct bailiffs to recover commercial rent arrears without the need for a court order. Providing there is an existing tenancy agreement (or a previous one in place that has expired) you can take recovery action as soon as the rent payment is at least 1 day in arrears. Upon receipt of your written authorisation, the bailiff is empowered to act on your instructions thus eliminating the need for lengthy court applications and litigation. There is no commission charge or fee to the landlord, agent or solicitor as the tenant pays the bailiff costs.
